He/She is not acting as an agent for a third party.

Whilst we endeavor to ensure that all the information about the products and services is correct, we do not warrant its completeness or accuracy; nor do we warrant that the information remains available or up to date.

2.4 Although we have taken great care to provide you with as accurate photos and images as possible for any available products on our website, we cannot guarantee their accuracy. By using our website, you acknowledge that the photos and images, available on our website for any product, are not accurate, and as such we are not liable for any noncompliance between any product received and the photos available on our website corresponding to this product.

2.5 When ordering on our website, you can select one or more products among the different categories offered. All offers presented on our Website are subject to available quantities. Whatever the product is, we shall not be liable for any limitation of quantity.

2.6 De La Valley does not warrant that the quality of any products, services, information, or other material order, purchased, or obtained by you on our website or any of our partners, suppliers, or other related parties to our business activity, will meet your expectations, or that any services will be error-free. 3. The Order

3.1 When placing an order on our website, you agree to provide us with accurate and complete details and information. 3.2 When placing an order on our website, you may be asked to log in or to register as a new customer. During the login or registration process, you will be asked to provide an e-mail address and a password. You must keep the combination of these details secure and never communicate them to a third party. Neither De La Valley nor any of our partners shall be liable for hacking (of any type) of your account on our website.

3.3 Any personal information submitted and collected on our website is governed by our Privacy Policy.

3.4 Any order placed on our website is subject to product availability, payment acceptance, delivery capacity, and final acceptance by us. After placing your order, you will receive an automatic confirmation email providing you with your order’s details. If any of the details on your order are wrong or inaccurate, you must immediately inform us. The only purpose of this email is to inform you that we received your order. This email is, in no way, proof of acceptance of your order.

3.5 Although we do our best to inform you about the available quantity for any product, we do not warrant the details are error-free. If the order you placed cannot be processed due to unavailable quantity you will be immediately informed. However, De La Valley is not liable for any mistake on product quantity details available on our website.

3.6 You agree that some products available on our website are subject to age ranges and cannot be purchased by customers under 18 years. We shall not liable, at any time, for the purchase and consumption of these products, by Client under 18 years old.

3.8 By providing false personal details and information, and/or impersonating the identity of a third party, you may be subject to legal proceedings under applicable law.

4. Prices and Payment Policy

4.1 When placing an order on our website, you agree to provide us with accurate and complete details and information. You warrant that any payment information and details you provide are personally owned, current, accurate, and complete.

4.2 You warrant that the credit or debit card details you provide us are the details of your own credit or debit card.

4.3 You warrant that you have enough funds to pay your order.

4.4 Before delivery, any order placed on our website must be paid in full using any of the payment methods available on our website.

4.5 Any payment details submitted and collected on our website are governed by our Privacy Policy.

4.6 All prices listed on our website are accurate and correct at the time of ordering. However, De La Valley reserves all right, at any time, for any reason, without notice, to modify any prices. De La Valley shall not be liable for any prices modification.

4.8 The total price for any order, including delivery charges, and other charges, will be displayed on our website when you place your order.

4.9 By providing false payment details and/or impersonating the identity of a third party, you may be subject to legal proceedings under applicable law.

5. Delivery

5.1 When placing an order with us (on our website), you warrant that the delivery details you provide are current, accurate and complete. If any of the details on your order are wrong or inaccurate, you must immediately inform us.

5.2 Our partners and we, shall not be liable for the inaccuracy of the information you provide us during your order or when creating your account, and the consequences this may have on delivery, including but not limited to: delay, losses, cancellation, extra costs, charges, or delivery penalties.

5.3 De La Valley and our partners, including but not limited to our delivery service partner, shall not be liable to you for any losses, damages, expenses, costs, charges, or liabilities resulting from late delivery.

5.4 De La Valley shall not be liable for any delay or failure in performing delivery when such failure results from any involuntary actions or omissions outside our control, directly or indirectly related to any unexpected, unanticipated, uncontrolled, and/or unpreventable events, including but not limited to: weather conditions, government order, or regulations of third parties.

5.5 In case of a delivery error leading either to the delivery products not included in the initial order of the consumer or to the lack of products compared to the initial order of the consumer, please contact us via email: contact@delavalley.com. We reserve all rights to collect the incorrect product delivered and to redeliver the missing products (if any).

5.6 All orders placed before 4:00 pm, Monday to Friday, will be delivered within 2 working days between 9:00 pm and 5:00 pm.

5.7 For any special inquiry about delivery or our products please contact De La Valley via email: contact@delavalley.com or indicate it in the note section before placing your order.

5.8 Delivery is free for all orders above HK$650. For orders under HK$650 will be subject to a HK$200 delivery fee.

6. Quality and Traceability

6.1 All products available on our website have a certificate of traceability and come directly from the producer to you without any processing in between.

6.2 Cold chain is respected for all chilled and frozen products: products are shipped, stored, and delivered in temperature controlled packages, boxes, and trucks.

6.3 All fresh and chilled products are vacuum packed.

6.4 Although we do our best to provide you with the best quality products, we do not warrant the quality and freshness of any product order on our website.

7. Accuracy, Completeness and Timeliness of Information

7.1 Whilst we endeavor to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date.

7.2 The material provided on this website is for the sole purpose of informing and should not be relied upon and/or used as the sole basis for decision-making without prior consultation of more complete, more recent, and more accurate sources of information.

7.3 The information concerning the Net Weight of any products available on our website is subject to a variation of +/- 15% of the given weight. We disclaim any liabilities for weight variations in accordance with these terms.

7.5 We reserve all right, at any time, for any reason, without notice, to modify any information, descriptions, details, and contents of this website.

8. Returns and Exchange

8.1 If you are not satisfied with any of the products you ordered on our website, De La Valley agree to provide you with a voucher or to replace all or parts of the total order after an assessment of your complaint has been made and approved by De La Valley.

8.2 The voucher is nominative and for single use. You shall not communicate your voucher code. In the case of non-compliance, you will be sued under applicable law.

8.3 To avoid any fraudulent activity, you will be asked to take an unsatisfactory application and, to provide us with the unsatisfying products as well as the package of each product. If you fail to provide us with all of the required proof of dissatisfaction, your complaint will be refused.

8.4 De La Valley reserves all rights, at any time, for any reason, to refuse any exchanges, returns or vouchers.

8.5 If you have any issues with any products ordered on our website, you have 24 hours after delivery has been accepted to contact us via: contact@delavalley.com. If you fail to contact us within this period, any exchanges, returns, or vouchers will be automatically refused.

8.6 It is your sole responsibility to check the contents of your order upon delivery before signing the delivery note. Once this note has been signed, your order is notified as fulfilled and any exchanges, returns, or vouchers are less likely to be granted.

12.2 We reserve the right, at any time, in our sole discretion, and to the maximum extent permitted under applicable law, to request you remove all links or any particular link to our website and you agree to immediately remove all links to our website upon such request. We also reserve the right, at any time, without notification, to modify these terms and conditions and their linking policy. 14. Loyalty Programme

14.1 Reward points must be redeemed within 12 months from the date of issue.

14.2 Reward points cannot be used in conjunction with any other offers, promotions, or events, e.g. VIP membership.

14.3 Reward points are non-refundable and cannot be exchanged for cash.

14.4 In case of dispute, De La Valley Ltd. reserves the right to make the final decision.

15. Referral Programme

15.1 A successful referral is defined as a new customer who resides in a location different from that of the existing/referring customer and who has not previously made a purchase with De La Valley under any email address or name, and actually places an order with us online, citing your name.

15.2 The “10% OFF discount” is a one-off offer.

15.3 Only one “10% OFF discount” offer may be used for every single purchase.

15.4 Only one Qualified Referral Discount can be earned for each Referred Friend. Any additional or subsequent purchases made by a Referred Friend will not be considered Qualified Referrals and thus not be entitled to the benefits of Qualified Referrals.

15.5 Referrers must only refer real individuals who meet the requirements of these Terms and Conditions. Referrers cannot refer themselves. For example, a Referrer may not create multiple or fake accounts with De La Valley or participate in the Program using multiple or fake email addresses or identities.

15.6 Referral discounts must be redeemed within 30 days from the date of issue (referring customer), and within 6 months from the date of issue (referred friend).

15.7 Referral discounts cannot be used in conjunction with any other offers, promotions, or events, e.g., VIP membership, etc.

15.8 Referral discounts are non-refundable and cannot be exchanged for cash.

15.9 In case of dispute, De La Valley Ltd. reserves the right to make the final decision.
